These Terms of Service ("Terms") govern your access to and use of Sioma's website (getsioma.com), mobile application, and precision agriculture platform (collectively, the "Service") operated by Sioma S.A.S. ("Sioma", "we", "us"). By accessing or using the Service, you agree to these Terms.
You must be at least 18 years of age and have legal capacity under Colombian law to enter into this agreement. By using the Service, you represent that you meet these requirements.
To access platform features, you must create an account using accurate and complete information. You are responsible for maintaining the security of your credentials. You agree to notify us immediately of any unauthorized access to your account at [email protected].
One account corresponds to one legal entity or individual farm operation. Sharing accounts across unrelated operations is not permitted.
Sioma grants you a limited, non-exclusive, non-transferable license to use the Service for your farm operations during your active subscription period. This license does not include:
You retain ownership of all farm data you provide - field boundaries, sensor readings, crop records. By using the Service, you grant Sioma a limited license to process this data to provide the Service features you use.
Sioma may use aggregated, anonymized datasets derived from platform usage for research and product improvement. Individual farm data is never included in these aggregates in an identifiable form.
Access to Sioma's platform features requires an active subscription. Subscription fees, billing cycles, and plan details are specified at the time of sign-up. Fees are charged in Colombian Pesos (COP) unless otherwise agreed.
Subscriptions renew automatically unless canceled at least 7 calendar days before the renewal date. No refunds are provided for partial subscription periods except as required by Colombian consumer protection law (Estatuto del Consumidor, Ley 1480/2011).
Sioma's platform provides data-driven recommendations to support your farming decisions. These recommendations are informational and do not constitute agronomic advice in a professional liability sense. Final decisions on irrigation, fertilization, pesticide application, and harvest timing remain yours.
Sioma is not liable for crop losses, yield shortfalls, or input costs resulting from decisions made using platform recommendations, provided those recommendations were generated from data you supplied.
We aim for 99.5% monthly uptime for core platform features. Scheduled maintenance windows are communicated 48 hours in advance when possible. Satellite data delivery depends on third-party imagery providers and may be delayed by cloud coverage or provider outages outside our control.
You agree not to use the Service to:
Either party may terminate the Service relationship with 30 days' written notice. We may terminate immediately if you materially breach these Terms and fail to cure the breach within 15 days of written notice. Upon termination, you may export your farm data within 30 days before it is deleted.
To the extent permitted under Colombian law, Sioma's total liability for any claim arising from these Terms shall not exceed the subscription fees you paid in the 3 months preceding the claim. We are not liable for indirect, consequential, or incidental damages including lost profits or crop losses.
These Terms are governed by the laws of Colombia. Disputes will be resolved in the courts of Bogota, Colombia, unless both parties agree to an alternative dispute resolution mechanism.
We will notify registered users 30 days before material changes to these Terms take effect. Continued use after that date constitutes acceptance.
